AG Campbell Announces $29.6 Million Multistate Settlement with Generic Drug Manufacturer Over Price Fixing Scheme

BOSTON — Massachusetts Attorney General Andrea Joy Campbell, alongside a coalition of 48 states and territories, today announced a $29.6 million multistate settlement with generic drug manufacturer Glenmark Pharmaceuticals, Inc., USA to resolve allegations that it engaged in a widespread, long-running scheme to artificially inflate prices, limit competition, and restrain trade with regard to numerous generic prescription drugs.  



Under the terms of the agreement, Massachusetts agencies will receive approximately $297,026 and Massachusetts consumers harmed by the actions of Glenmark and others will be eligible to claim compensation from a nationwide settlement fund. Glenmark will also be required to cooperate in the ongoing multistate litigation against 33 corporate defendants and 25 individual executives, and the company has agreed to a series of internal reforms to ensure fair competition and compliance with antitrust laws.  



The settlement follows similar settlement agreements with generic drug manufacturers Heritage PharmaceuticalsApotex, and Lannett Company and Bausch Health totaling $66.95 million. This latest settlement with Glenmark comes as states prepare for the first trial to be held in Hartford, Connecticut.

The first complaint in a trio of cases initiated by Massachusetts and coalition States and territories was filed in 2016 and named Heritage along with 17 other corporate defendants and two individual defendants in relation to 15 generic drugs. Two former Heritage Pharmaceuticals executives, Jeffery Glazer and Jason Malek, have since entered settlement agreements and are cooperating with the investigation.  



second complaint, filed in 2019 against Teva Pharmaceuticals and 21 of the nation's largest generic drug manufacturers, named 16 individual senior executives.  



third complaint — the first scheduled for trial — focuses on 80 topical generic drugs that account for billions of dollars in U.S. sales, and names 26 corporate defendants and 10 individual defendants.  



Seven additional pharmaceutical executives are cooperating to support the states’ claims. 

 

The cases stem from investigations built on evidence from several cooperating witnesses, a document database containing more than 20 million records, and a phone records database containing millions of call logs and contact information for over 600 sales and pricing personnel across the generics industry.  



In Massachusetts, this matter is being handled by Chief Anthony Mariano and Deputy Chief Jennifer Greaney, of the AGO’s Antitrust Division.
