BOSTON — Attorney General Andrea Joy Campbell today encouraged Haitian and Syrian Temporary Protected Status (TPS) holders to review resources that can help them prepare for potential changes to their immigration status and better protect their families during a time of uncertainty.
The Attorney General Office’s Emergency Planning Guide for Parents with Uncertain Immigration Status provides information to help parents identify trusted caregivers, organize important documents, and understand legal planning options available under Massachusetts law should parents or legal guardians be detained or otherwise become unable to care for a child.
While the Supreme Court’s decision allows the federal government to terminate TPS protections for Haiti and Syria, the current TPS designations and related work authorizations remain in effect until the Supreme Court sends a certified copy of its judgement to the lower court and the federal administration issues implementation guidance.
“Haitian and Syrian families across Massachusetts are facing tremendous uncertainty following the Supreme Court’s decision,” said AG Campbell. “While families continue exploring their legal options, I want them to know there are practical steps they can take today to protect their children in the event they are separated from them. No parent should have to make these decisions, yet having a plan in place can provide peace of mind during an incredibly devastating time.”
The Emergency Planning Guide explains several legal tools available under Massachusetts law, including:
- Caregiver Authorizations, which allow a trusted adult to make educational and medical decisions for a child while parents retain custody.
- Temporary Agent Authorizations, which allow parents to delegate broader parental authority for a limited time.
- Guardianship options for families facing longer-term separations.
- Guidance on organization important documents and identifying trusted emergency contacts.
The Attorney General’s Office also encourages Haitian and Syrian TPS holders to:
- Consult a qualified immigration attorney to understand whether they may qualify for another form of immigration. Legal assistance resources may be found, here.
- Beware of immigration scams and notario fraud.
- Keep copies of important identity, immigration, medical, and financial documents in a secure location.
- Discuss emergency plans with trusted family members or caregivers before an emergency occurs.
