Town of Pepperell Announces Legal Settlement in Long-Running Case to Stop Proposed Composting Operation

Pepperell - The Town of Pepperell announces that it has reached a legal settlement with Mass Composting
Group, Inc. (MCGI), concluding more than seven years of litigation over a large-scale composting operation
proposed for property off Route 111.
Since the project was first introduced, the Town has consistently opposed the development due to concerns
regarding environmental impacts, traffic, neighborhood compatibility, and compliance with local zoning and
public-health regulations. In response, the Town initiated legal action to prevent the project from moving
forward. Additionally, a grass-roots opposition led by local residents kept the issue in the forefront of town
efforts.
In 2022, the Land Court ruled in Pepperell’s favor. MCGI appealed that decision, and the Appeals Court later
remanded the matter back to Land Court, determining that the original ruling was too narrow and required
further consideration. About a year ago, the parties met to discuss a settlement rather than further litigation, the
parties have now agreed to a settlement that ends the dispute in its entirety.
Under the terms of the settlement, MCGI has formally withdrawn its proposal and agreed not to pursue the
composting operation at the site. The agreement preserves the Town’s regulatory authority and resolves all
outstanding claims.
“This settlement protects Pepperell’s residents, our environment, and our long-term planning goals,” said Mark
Mathews, Select Board Chair. “After years of uncertainty, the Town has secured a resolution that upholds our
bylaws and reflects the community’s priorities.”
The Town expresses appreciation to Special Counsel David McCay of Mirick Law, staff, Pepperell’s legislative
delegation, and the numerous community members who remained engaged throughout the process.
