1st Circuit Court Again Sides with Trump Administration, Keeping Law “Defunding” Planned Parenthood Enforceable

BOSTON — Today, the U.S. Court of Appeals for the First Circuit ruled in favor of the Trump administration and its backers in Congress in their effort to stop patients from using their Medicaid insurance at Planned Parenthood health centers. The law “defunding” Planned Parenthood is part of anti-abortion lawmakers’ years-long strategy to shut down Planned Parenthood health centers and block access to sexual and reproductive health care. The ruling jeopardizes care for 1.1 million Planned Parenthood patients by allowing the Trump administration to continue enforcing the “defund” law.
“Today, a court has once again allowed the Trump administration to enforce Congress’s unconstitutional ‘defund’ of Planned Parenthood — enabling their attempts to block access to care for patients most in need and force Planned Parenthood health centers to the financial brink,” said Alexis McGill Johnson, president and CEO, Planned Parenthood Federation of America. “The intent is clear: They want to shut down Planned Parenthood health centers and make it harder for everyone, everywhere to get the health care they need. But this is far from over. Planned Parenthood will never stop fighting for patients, and we will never stop serving the communities that rely on Planned Parenthood health centers for care.”
"By allowing the Trump Administration to defund Planned Parenthood, over one million people could lose access to high-quality, affordable sexual and reproductive health care. This law aims to block patients from getting care and to pressure Planned Parenthood health centers in states like Massachusetts that protect reproductive freedom into abandoning our values, but we will never do that,” said Dominique Lee, President and CEO of Planned Parenthood League of Massachusetts. “For as long as we are able, Planned Parenthood League of Massachusetts will continue to absorb costs and work with Massachusetts state lawmakers to ensure our patients with Medicaid are not forced to forgo or delay essential, time-sensitive care. This is not over, and we will never stop fighting for our patients’ right to control their bodies and get care from the provider they trust.”
The case was brought by Planned Parenthood Federation of America (PPFA), Planned Parenthood League of Massachusetts (PPLM), and Planned Parenthood Association of Utah (PPAU). This follows a previous ruling from the same court that allowed the Trump administration to enforce the “defund” Planned Parenthood provision. Despite its recognition of the “deleterious effects” of the “defunding,” the First Circuit nevertheless overturned a lower court’s preliminary injunction blocking the law. The appellate court sent the case back to the lower court for further proceedings on the merits of the case.
In November, a new report highlighted how Planned Parenthood health centers have shielded the overwhelming majority of patients who use Medicaid from out-of-pocket costs as the Trump administration and its Republican backers in Congress sought to stop them from getting care.
Since the ‘defund’ provision went into effect on September 12th, Planned Parenthood League of Massachusetts has covered over 4,500 visits free of charge for patients who – because of the federal law – are unable to use their Medicaid insurance at PPLM health centers. In response to the federal ‘defund,’ state lawmakers allocated $2 million for PPLM in the FY26 state budget, and Governor Healey directed additional funding for sexual and reproductive health in a supplemental budget that supports PPLM’s ability to continue seeing MassHealth patients.
“Because of increased support from the state and our generous donors, patients with MassHealth or other Medicaid plans can continue to receive all types of care at PPLM and will not have to pay out of pocket for their services,” said Dominique Lee, President and CEO of PPLM. “We made it clear that we'll provide care, no matter what, and our state stepped up to support our patients and providers in this critical moment.”
