MassDEP Penalizes Agawam Sand and Stone Facility for Stormwater Violations

BOSTON — The Massachusetts Department of Environmental Protection (MassDEP) has penalized J D T Rosati, Inc. (Rosati) $65,000 for violations of the state’s Wetlands Protection Act and Clean Waters Act at Rosati’s Silver Street property in Agawam.
The sand, stone and aggregate product supply company failed to implement required stormwater controls to manage rainwater and prevent erosion on its site, sending significant sediment runoff into nearby streams, a pond, and sensitive downstream wetland areas that flow into the Connecticut River.
"What may seem like routine business operations can have serious consequences for nearby wetlands and waterways when stormwater isn’t properly managed." said Michael Gorski, director of MassDEP's western regional office in Springfield. "Rosati has been cooperating and taking meaningful steps to restore and protect the ecosystem. Keeping wetlands and waterbodies free of sediment-laden water is crucial to protect water quality, aquatic habitats and ecosystem health."
Under the terms of the order issued by MassDEP and in addition to paying the $65,000 penalty, Rosati has agreed to install immediate and long-term stormwater management controls and implement restoration measures in the impacted area.
